We have changed the OpenAI entity that provides our services like ChatGPT to EEA and Swiss residents to our Irish entity, OpenAI Ireland Limited.

There are no changes for residents of the UK. OpenAI, L.L.C. will continue to be the service provider for UK users.

Using our Services

We have clarified what you can and cannot do when you use our services. We want everyone to use our services safely and responsibly, so we also include a list of examples of what users are prohibited from doing. It is important you read this section and our Usage Policies carefully.

Content

We updated this section to clarify your ownership rights in relation to input and output from our services, improve transparency on how we use your content, and include additional notice about how output from our services may be inaccurate.

Paid Accounts

We have included additional terms applicable to paid accounts and subscriptions (like ChatGPT Plus). We also include more information around our fees and your rights in relation to refunds and cancellations.

We have clarified that, as an EEA consumer, you have specific rights during the first two weeks after your purchase, this is called a “cooling off period” during which you can change your mind. We also note that you can cancel your paid subscription at any time.

Termination and Suspension

We have clarified that you can stop using our services at any time, and we link to instructions on how you can close your OpenAI account.

We have also increased transparency around when we may suspend or terminate your account and the process we will follow when we do so. We have also explained how you can appeal these decisions.

We have committed to providing our services to you with reasonable skill and care, and to act with professional diligence. We have also made clear that, as an EEA consumer, you have a legal guarantee that covers our services.

Which services are covered by the Terms of Use?

The Terms of Use apply to your use of ChatGPT, DALL·E, and any of OpenAI's other services that are intended for use by individuals. The Business Terms apply to the services intended for use by businesses, like ChatGPT Enterprise and the OpenAI API.

Why did we create separate Business Terms for ChatGPT Enterprise and the OpenAI API?

Business and organizational users often have needs and concerns that differ from those of individual users, such as data processing requirements and team management. The separate Business Terms are designed to address those specific aspects in detail.
